Validity and late tenders

Three separate rules. Firms lose by merging them into one hope.

Validity binds your price for months. Late lodgement usually kills the bid outright. Non-conformance is judged against the pack’s own terms. Each has its own clause; read all three. Part of our guide on how to read a 400-page tender in a day.

Takeaways

  • Validity, often 90 to 180 days, holds your price while the buyer evaluates. Cost the exposure.
  • Late is late. Portal timestamps decide; no universal grace exists.
  • Non-conforming is pack-defined. Some packs allow alternative offers; most do not.

What does the validity period oblige?

Your offer (price, resourcing, methodology) held open for the validity period the conditions name, commonly 90 to 180 days and sometimes longer on complex procurements. During that window the buyer may evaluate, negotiate, seek approvals, and award, while your costs move, your named staff take other work, and your subcontractor quotes expire. Price the validity exposure: escalation assumptions, key-person retention, and the point at which an extension request becomes a renegotiation.

Extension requests arrive as letters asking you to hold longer. Agreeing is not free; reprice or re-qualify before signing. Refusing may exclude you. Either way, decide with the current facts, not with the sunk pursuit behind you.

What happens to a late tender?

Almost always: exclusion, unopened. Electronic lodgement timestamps decide, not when you pressed send, not when the upload bar finished, but the system’s recorded receipt against the stated timezone and deadline. There is no universal late-tender acceptance rule and no universal rejection rule either: the pack’s lodgement clauses control, and some processes permit narrowly defined equitable correction of an unintentional error of form. That is a defined exception in defined circumstances, not a grace period, and never something to plan around.

The only lodgement strategy is margin: lodge early, verify receipt, keep the receipt. A bid team uploading at 4:52pm for a 5:00pm close has already made its risk decision, badly. Mandatory mechanics are covered on mandatory criteria; the process context is the Commonwealth Procurement Rules for Commonwealth work.

What makes an offer non-conforming?

Failure against the pack’s own conformity requirements: missing schedules, unsigned forms, departures the conditions forbid, alternative offers where none are invited. Some packs expressly invite alternatives or departures with a conforming offer alongside; read whether yours does before innovating. A non-conforming offer may be set aside without scoring, however strong its ideas.

What does this mean for the bid/no-bid call?

A validity period your pricing cannot survive is a pricing input or a no, decided before lodgement, not regretted during evaluation. A lodgement process your systems cannot meet (portal access, file limits, signing logistics) is a capacity fail on day one. Conformity is checked against the pack’s terms, in the compliance matrix, before writing ends, not discovered at opening.
