Victorian government tenders: Buying for Victoria and applicable local-jobs requirements.

Which Victorian buying and local-jobs requirements apply depends on the named buyer, whether this is goods-and-services or construction, and what the invitation actually requests. Local Jobs First is a statute with supplier guidelines, not a standard evaluation weighting in the title. Part of our guide on Australian government procurement.

Takeaways

  • Separate the buying regime (VGPB goods and services versus public-construction directions) from related policies.
  • Local Jobs First applicability and evidence sit in the current policy, supplier guidelines and the pack. Do not infer a weighting from the name.
  • Fair Jobs Code and the Social Procurement Framework are separate instruments on Buying for Victoria.
  • Confirm requested evidence before you write. Put held proof in a compliance matrix.

Which Victorian buying and local-jobs requirements apply to this opportunity?

Start with the issuing entity and the subject matter. A Victorian department buying goods or services sits under Victorian Government Purchasing Board (VGPB) supply policies. Public construction sits under ministerial directions and instructions, a different regime. Local Jobs First, Fair Jobs Code and social procurement may also apply, each on its own terms. None of those names, by itself, tells you the evaluation weight.

Inspected 16 September 2026: policy and supplier guidance live on buyingfor.vic.gov.au. Current tenders are reached from that site’s find-opportunities / browse-tenders path and from tenders.vic.gov.au, which is the portal already listed in where tenders are published. Recheck both destinations; portal hostnames move. Councils are not this page. They adopt their own procurement policies under the Local Government Act 2020.

Where do Victorian state notices live, and which buying regime is this?

On day one, register on the Buying for Victoria tender system, open the notice, and download the invitation to supply (or construction tender documents) plus every addendum. Then classify the pack before you classify the politics:

How to classify a Victorian state opportunity before reading local-jobs policies
Question If yes If no, or unclear
Is the named buyer a Victorian Government department or mandated agency, not a council? Continue on this page. Stop. A council policy is a different instrument.
Is the subject goods and services (including ICT and professional services)? Read VGPB goods-and-services policies and any related-policy tool the pack cites. Do not assume VGPB rules cover construction works.
Is the subject public construction (works or construction services)? Read the current Ministerial Directions and Instructions for public construction. Do not import construction directions into a goods-and-services invitation.
Does the invitation require registration on a panel, register or marketplace? Treat that registration as a participation condition held today, or it is a no-bid. Open tenders still have their own mandatories in the pack.

When does Local Jobs First apply, and what evidence is requested?

Local Jobs First is established by the Local Jobs First Act 2003. Official material, inspected 16 September 2026, lives at localjobsfirst.vic.gov.au, including supplier guidelines and an about page that currently describes Victorian Industry Participation Policy (VIPP) application by project value and location, and the Major Projects Skills Guarantee for specified construction labour. Reforms to the Act have been published as live. Recheck the current Act, policy, key documents and the invitation. Do not treat those about-page figures, or any evaluation treatment discussed in guidelines, as a universal weighting for every Victorian tender.

The title “Local Jobs First” on a cover sheet does not tell you the score. Applicability, any Local Industry Development Plan (LIDP), ICN acknowledgement, and any evaluation treatment are stated in the current guidelines and in this pack. If the pack does not request Local Jobs First evidence, do not invent a commitment. If it does, the evidence must be held in the form requested (typically an LIDP completed in the Victorian Management Centre) before you call the pursuit a bid. Broader local-content themes sit in local content, SME and Indigenous targets.

Policy-applicability checklist for a Victorian state invitation
Instrument What to verify in this pack Evidence the buyer may request
Buying regime Goods and services (VGPB) or public construction directions. Named buyer and mandated-agency status. Whatever the invitation schedules require: insurance, licences, nominated staff, methodology.
Local Jobs First Whether the invitation says the Act/policy applies, and whether VIPP, MPSG, Strategic Project or grant rules are named. Recheck current thresholds in the official policy, not this page. LIDP, ICN acknowledgement, local-content and jobs commitments, monitoring method. Only if requested.
Fair Jobs Code Separate policy on Buying for Victoria. Code text inspected 16 September 2026 (page updated 15 September 2026) treats a pre-assessment certificate as a precondition for defined threshold and high-value procurement contracts. Confirm current values and GST basis in the code. Valid pre-assessment certificate; for high-value contracts, an FJC plan or the construction-plan addendum the code allows.
Social procurement Separate Social Procurement Framework. Applies when the invitation includes social or sustainable objectives, not because Local Jobs First is mentioned. Social-benefit supplier status, commitments and reporting the schedules actually ask for.
Supplier Code of Conduct Often a related policy for goods and services. Read the invitation, not the annual report. Signed acknowledgement or equivalent returnable.

How do Fair Jobs Code and social procurement differ from Local Jobs First?

They are different jobs. Local Jobs First is industry development and, where MPSG applies, apprentice/trainee/cadet labour on specified construction. Fair Jobs Code is labour-standards prequalification and, at high value, a plan about how people are engaged. Social procurement is social and sustainable purchasing objectives in the Victorian framework. A supplier can face none, one, or several on the same invitation. Crossing the names in a method statement is how teams write commitments they cannot evidence.

What does a hypothetical Victorian invitation require on day one?

The example below is Hypothetical. It is not a live public URL.

Hypothetical Victorian goods-and-services invitation used to demonstrate policy applicability
Field Hypothetical invitation Reading note
Label Hypothetical Do not treat this as a current ATM.
Buyer Department of Health (Victorian Government) State agency, not a council.
Subject Managed ICT support for a metropolitan health service, three-year term Goods and services. VGPB path, not public-construction directions.
Portal Buying for Victoria tender system / tenders.vic.gov.au Register, download the invitation to supply, log addenda.
Local Jobs First Invitation is silent. No LIDP schedule. Do not invent an LIDP or a local-jobs score. Recheck addenda. If an addendum later applies the policy, re-open the gate.
Fair Jobs Code Conditions require a current pre-assessment certificate at lodgement If the certificate is not held today, the call is no unless the pack states an exception that actually fits.
Social procurement One scored question on Aboriginal business participation in the supply chain Score the evidence you can put on the page. A Thursday conversation is not a named subcontractor.
Next action Matrix the mandatories, the Fair Jobs Code certificate, and the social-procurement question Use the compliance matrix. Do not start the method statement first.

What does this mean for the bid/no-bid call?

Call no if a participation condition (panel membership, Fair Jobs Code certificate, LIDP acknowledgement, licence) is required and not held today. Call review if you cannot yet say whether this pack is VGPB or construction, or whether Local Jobs First is actually requested. Do not bid on the strength of the policy name. Recheck Buying for Victoria, Local Jobs First key documents and the invitation. This page is not legal advice.
